1. Introduction Welcome to www.leadwapp.in (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern your access to and use of our Bulk Official Meta API Messaging Web Portal (“Platform”), which enables businesses to send WhatsApp messages using the official Meta API. By accessing or using our Platform, you agree to comply with these Terms. If you do not agree, you must not use our services. 2. Description of Services Our Platform provides: Official WhatsApp Business API integration Bulk messaging tools Template message management Contact management Campaign tracking and analytics Automation and chatbot features We operate strictly under the policies of Meta Platforms Inc. and the official WhatsApp Business Platform guidelines. 3. Eligibility You must: Be at least 18 years old Be legally capable of entering into a binding agreement Use the Platform only for lawful business purposes Provide accurate and complete registration information 4. Compliance with WhatsApp & Meta Policies You agree to: Follow all WhatsApp Business Platform policies Send messages only to users who have provided explicit opt-in consent Avoid spam, harassment, fraud, or misleading content Not send prohibited content (illegal, adult, gambling, fake promotions, etc.) Violation of Meta or WhatsApp policies may result in: Immediate suspension of your account Permanent ban from the Platform WhatsApp Business number disconnection We are not responsible for bans or restrictions imposed by Meta or WhatsApp. 5. User Responsibilities You are solely responsible for: The content of messages sent through the Platform Maintaining consent records from recipients Managing your WhatsApp Business Account Compliance with applicable laws (including data protection and anti-spam laws) You agree not to: Upload purchased or scraped contact lists Use the system for phishing or fraudulent campaigns Attempt to reverse engineer or misuse the API 6. Payment & Billing Services are provided on a prepaid or subscription basis. Message delivery charges depend on WhatsApp conversation-based pricing. Payments are non-refundable unless explicitly stated. Failure to pay may result in service suspension. We reserve the right to change pricing with prior notice. 7. Account Suspension & Termination We reserve the right to: Suspend or terminate accounts for policy violations Remove harmful content Restrict access without prior notice in case of abuse Termination does not waive outstanding payment obligations. 8. Data Protection & Privacy We process data according to our Privacy Policy. You acknowledge that: You are the data controller of your customer data We act as a data processor Meta may process data independently under its own policies You must comply with applicable data protection laws such as: Information Technology Act, 2000 (India) GDPR (if applicable) 9. Limitation of Liability We are not liable for: Message delivery failures caused by WhatsApp or Meta Account bans imposed by Meta Business losses, indirect damages, or revenue loss Technical downtime beyond our control Our total liability shall not exceed the amount paid by you in the last 30 days. 11. Third-Party Services Our Platform depends on services provided by: Meta Platforms Inc. WhatsApp We are not responsible for changes in their policies, pricing, or service availability. 12. Indemnification You agree to indemnify and hold harmless www.leadwapp.in from any claims, damages, or legal expenses arising from: Your misuse of the Platform Violation of laws Breach of these Terms Complaints from message recipients 13. Service Availability We strive to maintain 99% uptime, but we do not guarantee uninterrupted service. Maintenance, updates, or third-party outages may affect availability. 14. Modifications to Terms We may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of revised Terms. 15. Governing Law & Jurisdiction These Terms shall be governed by the laws of India Any disputes shall be subject to the jurisdiction of courts located in that region.
